CRIMINAL LAW -
Local, State & Federal Court

The Commonwealth of Pennsylvania’s laws are generally prosecuted by the Pennsylvania Attorney General with local offices statewide.  This office has defended numerous clients in cases brought by the Attorney General.

The Attorney General will generally prosecute cases that are statewide in impact, and whose activities cross multiple county jurisdictions. Contrary to cases brought by the Attorney General, local District Attorneys prosecute cases for alleged crimes that are committed wholly with the county by which they are elected. Their jurisdiction therefore is limited solely to within said county. Attorney John Zagari has defended numerous individuals in many counties within this commonwealth. He has also represented individuals in many different jurisdictions outside of this commonwealth by special petition.

The Federal Prosecutor’s office generally prosecutes all crimes listed in the United States Criminal code.  I am and have been a member of the Bar of the Western District of Pennsylvania Federal Court since 1981 and the Bar of the Supreme Court of the United States since 1986.  I have litigated numerous cases in the Federal Courts.

Engaging the services of private investigators, as well as other relevant professionals, is an important part of preparing my defense. The use of private investigators as well as other resources help to create better odds of securing a reasonable resolution of your case. DUI DEFENSE - With the lowering of the legal blood alcohol limit to .08 as well as the expansion of the use of sobriety checkpoints, the number of DUI arrests continues to rise.  I have generally found that there has been significant confusion among potential clients in regards to their rights in relationship to the current DUI laws.

DRUGS - It is safe to say that drug task forces made up of highly experienced federal, state, and local law enforcement officers is on the rise. It is therefore vitally important that if you find yourself on the unfortunate end of such a criminal investigation that you retain experienced legal representation to advocate and assert your rights.

WHITE COLLAR CRIMES - It is obvious that the prosecution of white collar crimes is no longer a minor occurrence. All of the above-referenced law enforcement agencies have been very active in their prosecution of white collar crimes, such as embezzlement, fraud, corruption, money laundering, and tax evasion.

JUVENILE CRIMES -
 Recently the Commonwealth of Pennsylvania’s legislature enacted major changes to the juvenile statutes. It is now possible for one’s juvenile record to continue with him/her and have an effect on his/her life as an adult. I have, on a number of occasions, been confronted with an adult client who has discovered that he has a criminal record as a result of a juvenile conviction. It is therefore vitally important that one understands that there is no juvenile matter that should be overlooked and that you truly understand your rights and the repercussions of the charges that have been made against you.

UNDERAGE DRINKING - A good example of a juvenile crime that brings with it additional punishments unrelated to the original charge is underage drinking. If a juvenile pleads guilty to said offense he receives a notice from the Pennsylvania Department of Transportation that his license has been suspended. In Pennsylvania a conviction for underage drinking results in an automatic license suspension with all of the associated insurance type consequences. The question becomes, would that individual have plead guilty had he known the ramifications of his plea?

ASSAULT (Aggravated, Simple, Reckless Endangerment) - Generally these crimes involve high emotions as well as physical contact or the threat of said contact. It is imperative that you seek qualified legal counsel immediately.

THEFTS - We handle crimes that range from physical face-to-face taking of one’s property to a more sophisticated form of theft, such as the use of counterfeit documents. Once again, the early involvement of defense counsel and experts is critical to the defense of these cases.

WEAPONS - In recent years, our courts and legislature have enhanced the punishments for illegal weapon use. This illegal use of weapons has been targeted by most law enforcement agencies for strict enforcement and mandatory sentencing.
